The three-year transition period for Ontario’s Blue Box program officially concluded on December 31, 2025. As of January 1, 2026, the legal and financial burden of residential recycling has migrated from municipalities to companies supplying packaging and paper products to consumers in Ontario.

The three-year transition period for Ontario’s Blue Box program officially concluded on December 31, 2025. As of January 1, 2026, the legal and financial burden of residential recycling has migrated from municipalities to companies supplying packaging and paper products to consumers in Ontario. Under the regulations, these companies are referred to as Producers.  

What the January 1st Milestone Means for Producers 

While the public sees a new, expanded list of recyclables, Producers now face a high-stakes regulatory framework under O. Reg. 391/21. 

  • Financial Responsibility: Producers are now 100% responsible for funding the province’s recycling system. 
  • Unified Scale: The Common Collection System (CCS) is now live across the province, covering roughly 400 communities. The CCS is the Blue Box material collection and management system established by PROs on behalf of producers.  
  • Expanded Scope of Materials: The list of acceptable materials has broadened to allow more types of household packaging. This expanded list can be found here 
  • Uniformity Across Ontario: A single unified EPR framework exists. The same materials are now accepted from all communities.  
  • Small Business Changes: There have been changes to collections from Industrial, Commercial, and Institutional (IC&I). Some of these businesses may now be classified as "Non-Eligible Sources" and may need to contract collections through commercial recycling services.

Clarifying the Hierarchy – “Who is the Producer?” 

One of the greatest risks is misidentifying your role in the supply chain. The regulation uses this hierarchy to determine the obligated party (Producer) for the portion of the product packaging added to the product. This is a simplified hierarchy. Your Role and When You Are The "Producer"

  • Brand Holder: When you own the brand and have a permanent establishment (residency) in Canada.
  • Importer: When the Brand Holder is not a resident, the Importer is a resident of Ontario and imports the product from outside of the province.
  • Retailer: Neither the Brand Holder nor the Importer, the retailer supplies the product directly to consumers in Ontario.
  • Marketplace Facilitator: When the retailer who would be the producer is a marketplace seller, the marketplace facilitator is the Producer.
  • Franchisor: The franchisor is the Producer when franchisees are resident in Ontario.

For any portion of the packaging not described in table, the Producer is the retailer who supplied the product to consumers in Ontario.
